What is a Section 7 agreement?

Section 7 of British Columbia's Declaration on the Rights of Indigenous Peoples Act authorizes ministers to enter agreements with Indigenous governing bodies for joint or consent-based exercise of specified statutory decision-making powers. Each agreement is project-specific, negotiated, and voluntary; it must be authorized by the Lieutenant Governor in Council (Cabinet) and published in the BC Gazette to take effect. No Section 7 agreement is a general transfer of authority, and none can be signed without Cabinet approval.

'Namgis North Island forestry

Cabinet authorized negotiations on 2025-06-18. Teẑtan Biny sits within the area over which the Tŝilhqot'in hold Aboriginal title recognized by the Supreme Court of Canada in Tsilhqot'in Nation v. British Columbia (2014).

Red Chris mine

Eskay Creek mine

Cabinet approved the final agreement via OIC 0307-2022 in June 2022. Environmental assessment completed; project received formal approval in January 2026. Described by Nalaine Morin (Tahltan Nation) as proof that DRIPA works.
